Tiburon commission rubber stamps second-unit alignment with state laws

Tiburon planning officials have agreed to update local second-unit rules to align with existing and pending state laws — such as allowing up to eight detached accessory dwellings on multifamily lots — but there was no discussion of optional changes like increasing maximum sizes or allowing units to be sold individually like condos.
Town officials also acknowledged Tiburon won’t meet the Jan. 1 deadline to provide residents with a selection of preapproved unit designs, which it won’t start to develop until after the new year.
The Planning Commission voted 4-0 at its Dec. 11 meeting, with Vice Chair Daniel Amir absent, to move forward with the selection of updates recommended by staff, which mostly focus on ensuring town codes minimally comply with state laws on by-right, checklist approval of second units at the staff level that took effect in 2024, plus several that are about to become law on Jan. 1.
Commissioners made only minor changes to the recommendations, the most notable to continue issuing courtesy notices to neighbors when a ministerially approved second-unit project is about to begin.
